Upcoming Changes to Retail Food Permits


September 03, 2025

During the 89th Texas Legislative Session, new state laws were passed that directly impact how NET Health regulates retail food establishments.


As a result, several important changes are coming to how we issue permits, conduct inspections, and structure fees for local businesses.

What’s Changing?

  • New limits on how local governments can set permit and reinspection fees
  • Elimination of local food permits for certain child care centers
  • Statewide permit transition for mobile food vendors (food trucks) by July 2026
  • Required email opt-in for all permit holders to receive future updates
  • Late renewals will incur a $100 fee in line with state policy

📅  When Will This Happen?

  • September 1, 2025 – New laws take effect
  • October 2025 – Updated local fee schedule may begin (pending Board approval)
  • July 1, 2026 – Mobile vendor permitting moves to Texas DSHS
